Supreme Court Rules to Preserve Telehealth Access to Mifepristone For Now

Alexandria, Va – Today the Supreme court of the United States issued a ruling in Danco Laboratories v. Louisiana after a temporary stay last week. The Justices extended the stay against the 5th Circuit Court decision that banned the dispensing of mifepristone by mail order, restoring telehealth access to mifepristone across the United States for now. A court case to determine the appropriateness of FDA’s approval of mifepristone will likely return to the high court at a later date, so this action does not permanently protect access.
“The Supreme Court has clearly kicked the can down the road with today’s decision, which only temporarily restores access to mifepristone via telehealth,” said Tarina Keene, executive director of REPRO Rising Virginia. “This ruling invites future attacks on all aspects of reproductive healthcare including FDA approval of mifepristone, which has been a safe and effective form of abortion care for decades. Since the ruling in Dobbs, opponents of abortion have been determined to take away access to life-saving healthcare at every turn, and this temporary setback won’t stop them. We’ll continue to work to expand and protect access to care, and we’re not satisfied with the decision the Supreme Court announced today.”
